A was earlier convicted under Chapter XVII with imprisonment for 4 years. After release, A again commits another offence under the same chapter punishable with imprisonment for 4 years. Which of the following is legally correct under the Bharatiya Nyaya Sanhita, 2023 in India?

ExplanationAnswer and explanation

Answer: (C) A becomes liable to either life imprisonment or imprisonment up to 10 years.

The Bharatiya Nyaya Sanhita, 2023 (corresponding to Section 75 of the IPC) provides for enhanced punishment for repeat offenders. A person previously convicted of an offence under the chapter on offences against property, punishable with imprisonment of three years or more, who again commits an offence under that chapter punishable with imprisonment of three years or more, becomes liable to imprisonment for life or imprisonment up to ten years.
•
The enhancement applies to a second or subsequent offence of this kind, not just to identical offences.
•
Both the earlier and the later offences must be punishable with imprisonment of three years or more.
•
Life imprisonment is an alternative, not a mandatory punishment.
