___________ is NOT covered under Article 20 of the Indian Constitution.
ExplanationAnswer and explanation
Answer: (D) Principle of legitimate expectation
Article 20 protects a person in respect of conviction for offences: it bars ex-post facto criminal laws (20(1)), double jeopardy (20(2)) and compulsion to be a witness against oneself, i.e. self-incrimination (20(3)). The principle of legitimate expectation is a doctrine of administrative law developed by courts and is not covered by Article 20.
•
Article 20 cannot be suspended even during a National Emergency (Article 359, as amended by the 44th Amendment).
•
Article 21 (life and personal liberty) is likewise non-suspendable.
•
Article 20 is available to citizens and non-citizens, but only against prosecution for criminal offences.
