In which situation can the Governor exercise the power under Article 161?
ExplanationAnswer and explanation
Answer: (B) The person must be convicted of an offence against a law relating to a State matter.
Under Article 161, the Governor can grant pardon, reprieve, respite or remission of, or suspend or commute, the sentence of a person convicted of an offence against a law relating to a matter to which the executive power of the State extends. Hence the person must be convicted, and the offence must relate to a State matter.
Merely being accused is not sufficient.
In cases of death sentence, the Governor cannot grant a pardon; that power rests with the President.
The Governor does not have the power to pardon a sentence passed by a court martial.
The President's power of pardon is given in Article 72.
