During a National Emergency proclaimed on the ground of war or external aggression, if the President does not issue a separate order under Article 359, which of the following correctly describes the enforceability of Fundamental Rights?

ExplanationAnswer and explanation

Answer: (B) Article 19 is suspended, while the remaining Fundamental Rights continue to be enforceable.

On the proclamation of a National Emergency on the ground of war or external aggression, the Fundamental Rights under Article 19 are automatically suspended under Article 358; no separate order of the President is required. The remaining Fundamental Rights continue to be enforceable unless the President suspends their enforcement under Article 359.
The enforcement of Articles 20 and 21 cannot be suspended even under Article 359 (44th Amendment, 1978).
Article 19 is suspended only on the ground of war or external aggression, not on the ground of armed rebellion.
